I - GENERAL INFORMATION ABOUT THE COMPANY

HERCOSUL ALIMENTOS LTDA, a legal entity governed by private law (hereinafter referred to as “Hercosul”), headquartered in the City of Ivoti, State of Rio Grande do Sul, at Avenida Capivara No. 1.000, Morada do Sol, CEP: 93900-000, enrolled with the CNPJ/MF [Corporate Taxpayer ID] under No. 06.252.545/0001-83. Hercosul is dedicated to the manufacture and sale of pet food, among other activities.

II - ACCEPTANCE AND CHANGE IN THE GENERAL SITE CONDITIONS

These General Conditions regulate the use of this Website on the Internet (the “Website”) that Hercosul makes available to the Holder (the “Holder”). The use of this Website presupposes the Holder’s full, complete and unreserved acceptance of each and every term of the General Conditions in effect at any given time, and the Holder shall refrain from using the Website if any of the conditions contained in these General Conditions is not accepted by the Holder.

CHANGE IN THE GENERAL CONDITIONS

Hercosul reserves the right to change these General Conditions for the use of this Website at any time, as well as any other general or particular conditions, regulations of use, instructions or notices that may be applicable. Therefore, the Holder must read these General Conditions each and every time he/she accesses the Website. Therefore, the Holder expressly and fully accepts that access to and use of this Website will be under his/her sole and exclusive responsibility.

PERSON RESPONSIBLE FOR PROCESSING, DATA CONTROLLER, PURPOSE AND RECIPIENTS

Unless otherwise stated, Hercosul is the entity responsible for the processing of all the personal data collected on this website. This data protection policy may vary with time due to possible changes in legislation, court precedents or the criteria followed by the National Authority for Data Protection. Hercosul informs the holders of personal data (Holders) that it complies with the current data protection legislation and, in special, the General Data Protection Law No. 13.709/2018 (LGPD). PERSONAL DATA TO BE PROCESSED

Hercosul will process the following personal data:

The initial data you provide voluntarily regarding your registration request as a Holder, your request for information to our company, your request to participate in promotions, or your request to receive services offered by Hercosul. In each form, we will indicate clearly and precisely the data you must provide to be able to carry out the request, application or service you request from us at any time.
The data that, after the initial request, are created or exchanged with the Holder when Hercosul fulfills the initial request.
The data obtained from the interconnection of the different devices with which the Holder interacts in Hercosul’s website.
The data obtained from the generation of anonymous identification numbers and their attachment to the accounts of Registered Holders.
Personal data that the Holder provides via a social network (e.g., Facebook, Instagram etc.) in order to manage their request. This data depends on each Holder’s privacy settings, each Holder’s use of the social network, as well as the privacy policies of the social network in question.

PURPOSE OF DATA PROCESSING

Hercosul respects the holders’ rights to privacy, and therefore states that it will process the Holders’ data in order to manage and process the requests it receives from the Holders, whether for information, registration, participation in promotions or receipt of services. Therefore, it will process the data of the Holders in order to send, including by electronic means, promotional information on its products and services that are similar in nature to those that are the subject of the requests received by the Holders.

DATA PROCESSING LEGITIMACY

Hercosul is entitled to process the data for the purpose of managing and processing the Holders’ requests, as necessary for the fulfillment of Hercosul’s contractual obligations regarding said requests. As regards the analysis of the data obtained and the sending of promotional information on products and services of a similar nature to those that are the subject of the Holders’ requests or purchases, such processing constitutes a legitimate interest of Hercosul, expressly recognized by the legislation on data protection, as well as by the legislation on information society services. The Data Holder may object to receiving, now or at any time, commercial communications regarding Hercosul products and services, by sending an email to privacidade@hercosul.com.br.

ASSIGNMENT TO THIRD PARTIES

Hercosul will only transfer the data of the Holders to Hercosul affiliates of which activities are related to pet food, products and services for the same purposes indicated in the subsection “Registration of personal data, purpose and recipients” of this section “III.- Personal Data”, regarding the respective activity of each affiliate when said transfer is necessary and indispensable for the fulfillment of the processing purposes described in the section “Purpose of data processing” of this privacy policy. Moreover, in accordance with the legislation in force, and with the scope and limitations provided for in it, Hercosul may transfer the Holder’s data to public administrations and authorities when it is required to do so by virtue of the legislation that regulates the activity of Hercosul. Except for these cases, Hercosul will not give the Holder’s personal data to third parties without the Holder’s express consent in each case. Hercosul informs that it collaborates with third parties that will act as service providers according to the legal provisions; these providers may have access to your personal data with the purpose of providing the services and/or complying with the obligations arising from the legal relations maintained between these third parties and Hercosul in the development of Hercosul’s activity. In any case, Hercosul has signed the corresponding confidentiality and data protection agreements with these suppliers, in full compliance with the current legislation on data protection.

WARNING TO THE UNDERAGE

Hercosul informs the Holder that users under the age of 13 are not allowed to register on the Website and, therefore, to participate in any promotional activities that Hercosul may carry out related to its activities and products. Furthermore, the Holder is informed that if he/she is over 13 years old and under 18, it is advisable to inform his/her parents or representatives before accessing the Website, so that they may explain to him/her these General Conditions and, in particular, the personal data protection policy contained in these General Conditions and, therefore, to participate with them in the possibilities offered by this Website, without prejudice of the specific cases for which the law requires the parents or representatives of users over 13 year old and under 18 to assist such minors to give their consent to the processing of their personal data.

HOLDER’S RIGHTS

Hercosul respects the privacy rights of the holders: (i) Confirmation of the existence of data control; (ii) Access to data; (iii) Correction of incomplete, inaccurate or outdated data; (iv) Anonymization, blocking or elimination of unnecessary, excessive data or data processed in violation of the law; (v) Portability of data to another service or product provider, upon express request by the User; vi) Deletion of data processed with the consent of the user; vii) Obtaining information on the public or private entities with which the user has shared his/her data; viii) Information on the possibility of the user not giving consent, as well as being informed of the consequences in the event of a refusal; ix) Revocation of consent. INTERNATIONAL DATA TRANSFERS

Hercosul has the services of technological suppliers located in countries that may not have legislation equivalent to the Brazilian legislation (“Third Countries”). Due to the purposes established in this Privacy Policy, Hercosul may transfer your data to such suppliers, who prove to follow the laws applicable to the protection of personal data and confidentiality of Third Countries. Hercosul informs that it adopts reasonable security measures to protect the confidentiality, security and integrity of the Holders’ personal data. It also informs that it uses security measures to help protect the Holders’ personal data against unauthorized disclosure, illicit use or alteration, which may happen with all devices connected to the internet. For these reasons, Hercosul cannot guarantee the security of the information provided through the internet, and it is not responsible for security failures that are beyond its reasonable control.

RETENTION PERIOD OF YOUR DATA

The personal data of the Holder will be kept for as long as the relationship with Hercosul remains in force. After the end of the relationship with the Holder, Hercosul will keep the Holder’s data during the applicable legal and/or contractual limitation periods. In this case, they shall be processed exclusively for the purpose of certifying the fulfilment of our legal or contractual obligations. Once the aforementioned statute of limitations has expired, the respective data will be deleted or, whenever possible, anonymized.

Hercosul undertakes to process the User’s personal data confidentially, adopting the necessary security measures, technical or organizational, that guarantee the security of the personal data and prevent their alteration, loss, processing and/or unauthorized access, taking into consideration the state of technology, the nature of the data stored and the risks to which they are exposed, in accordance with the provisions of the LGPD and the respective development legislation. Hercosul guarantees, to the extent possible and according to the current state of technology, the confidentiality and integrity of the data and information provided by users to fulfill the purposes indicated above.
